Michael Jordan Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

The basketball icon, introducing himself formally in a federal courtroom on Friday, admitted that his drive to win and novelty within the sport motivated his effort with 23XI Racing to ā€œchallengeā€ Nascar over perceived violations of antitrust rules.

Team Investment and a Competitive Drive

The owner disclosed financial and corporate details of his racing venture, saying he invested $40 million of his own funds into the Cup Series operation launched with partner Polk and driver Hamlin.

ā€œSomeone had to step forward,ā€ Jordan said in the Charlotte courtroom. ā€œAs a newcomer, I had no fear. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.ā€

Central Issue: Franchise System and Renewal Demands

At issue is the expiration of a 2016 agreement where Nascar granted each team a franchise. The concept is similar to other professional sports with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded teams renew their charters.

Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with fans and media clamoring for a glimpse or a picture of the global icon.

Leading the Legal Charge

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is breaking the law to maintain excessive control.

At issue for Jordan and a fellow team representative, who testified before Jordan, are details from September 2024. She recounted a frantic and emotional period where the racing circuit told teams they must sign a contract extension. The document spanned over a hundred pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports concluded their sole viable path was to refuse a signature that extensive document and take the issue to court. All other teams agreed to the terms.

The team owners reached out to Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.

But in the end, the pushback against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Success.

ā€œHamlin persuaded me getting a third driver improved our chances to win,ā€ he testified, noting that he purchased another franchise last year for $28 million amid the legal dispute. ā€œSo I took the plunge.ā€

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.

She said, the team founder first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.

ā€œDon’t do this to us,ā€ Gibbs recounted was the message to Nascar’s executives. She said France replied, ā€œWhether I have 20 charters, that’s what I have. If I have 30, I have 30.ā€
